On Demand Online Beta Terms of Service
These On Demand Online Beta Terms of Service (“Beta Terms”) use the terms “Comcast” or “we” to refer to Comcast Cable Communications Management, LLC, Comcast Interactive Media, LCC, and their respective subsidiaries and affiliates that own and operate web sites and Internet services on their behalf. The term “you” refers to you as a user of the On Demand Online Beta service.
These Beta Terms contain the terms and conditions through which Comcast will permit you to participate in the On Demand Online Beta service. These Beta Terms are made in addition to the other terms and policies that apply to you, including:
(1) the Fancast Terms of Service, available here: http://www.fancast.com/info/terms;
(2) the Fancast Privacy Policy, available here: http://www.fancast.com/info/privacy; and
(3) the terms and policies that apply to you as a subscriber to the Comcast High-Speed Internet Service, available here: http://www.comcast.net/terms/.
By using the On Demand Online Beta service, you agree to abide by these Beta Terms, and all other applicable terms and policies. For your reference, a copy of these Beta Terms will be available in the Frequently Asked Questions section of Fancast, available here: www.fancast.com/help.
In order to use the On Demand Online Beta service you may be required to provide information about yourself (such as identification or contact details) as part of the registration process. You agree that any registration information you give to Comcast will be accurate, correct, and current. In addition, you represent and warrant that you are not an employee, officer, director, consultant or agent for any competitor (meaning (1) any provider of any paid or free video service, whether as a multi-channel television service provider (such as satellite, cable television or IP television service) or any other video content aggregator and (2) any other company that provides hardware, software, or services having the primary purpose of delivering video content using the internet) or any affiliate of any competitor. If you become related to or affiliated with any competitor, you agree to notify Comcast immediately and Comcast shall be permitted to terminate your participation in the On Demand Online Beta service.
You understand and acknowledge that the On Demand Online Beta service is being provided as a “Closed Beta”, and is made available on an “AS IS” and “AS AVAILABLE” basis for the purpose of providing Comcast with feedback on the quality and usability of the On Demand Online service. The On Demand Online Beta service may contain errors or inaccuracies that could cause system failures, crashes, or other disruption to the normal operation of your computer. Comcast strongly encourages you to back-up all data and information on your computer prior to using the On Demand Online Beta service. YOU ASSUME ALL RISKS AND ALL COSTS ASSOCIATED WITH YOUR USE OF THE ON DEMAND ONLINE BETA SERVICE, INCLUDING, WITHOUT LIMITATION, ANY INTERNET ACCESS FEES, BACK-UP EXPENSES, COSTS INCURRED FOR THE USE OF YOUR COMPUTER AND PERIPHERALS, AND ANY DAMAGE TO ANY EQUIPMENT, SOFTWARE, INFORMATION OR DATA. In addition, Comcast is not obligated to provide any maintenance, technical, or other support for the On Demand Online Beta service.
You agree that the On Demand Online Beta service is solely for your personal and non-commercial use, is available only to you, on a non-transferable basis, is available for use only in those residence(s) in which you have Comcast High Speed Internet Service, and that at any given time there will be, in the aggregate, no more than 5 simultaneous video streams associated with all primary and secondary accounts included in your High Speed Internet Service account. If you use the On Demand Online Beta service in violation of the restrictions referenced herein (including the Beta Terms, the Fancast Terms of Service and the terms associated with use of the Comcast High-Speed Data Internet Service), Comcast may, in its sole discretion, suspend or terminate your access to the On Demand Online Beta service.
You agree that the On Demand Online Beta service is not open to the public, and you agree to keep confidential all information (including but not limited to functions, features and graphics) about the On Demand Online Beta service, and your experience with the On Demand Online Beta service, and you agree not disclose such information to any other person, except for purposes of providing feedback to Comcast as described below, and you acknowledge that this obligation will survive until the On Demand Online service is generally made available to the public (even if your participation in the On Demand Online Beta service is or has been terminated). You also agree that you will not film, screenshot or otherwise record any portion of the On Demand Online Beta service, or otherwise distribute any of the foregoing.
Comcast reserves the right to modify, suspend or stop your participation in the On Demand Online Beta service (or any part thereof), either temporarily or permanently, at any time or from time to time, with or without prior notice to you. Nevertheless, we will try to give you prior notice of changes whenever we reasonably can. Comcast may provide notice of any changes to the On Demand Online Beta service by posting them on its web sites and/or via the program itself, among other ways. You agree that Comcast shall not be liable to you or any third party for any modification or cessation of the On Demand Online Beta service. You acknowledge that Comcast has no express or implied obligation to provide, or continue to provide, the On Demand Online Beta service, or any part thereof, now or in the future. In addition, Comcast may at any time, upon prior notice as required by applicable law and with your prior, express approval, institute charges or fees for the On Demand Online Beta service.
As part of using the On Demand Online Beta service, Comcast may provide you with the opportunity to submit comments, suggestions, or other feedback regarding your use of the On Demand Online Beta service. You agree that in the absence of a separate written agreement to the contrary, Comcast will be free to use any feedback you provide for any purpose related to Comcast’s products and services.
As part of Comcast’s delivery of the On Demand Online Beta service, Comcast will use the name, address, or your Comcast.net e-mail address to obtain information about your Comcast Cable Television subscription from our billing systems, including without limitation, your billing address and information about your cable television subscription package (“Cable Information”). Comcast will use this Cable Information to verify whether you are authorized to access certain content offered through the On Demand Online Beta service. If you do not want your Cable Information used for this purpose, then you may choose not to sign up for the On Demand Online Beta service, or stop using it at any time if you have already signed up for it.
